By purchasing a subscription or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
2. Service Description
gitpage provides an AI-powered landing page generation service that creates websites and deploys them to GitHub Pages or GitLab Pages. Users provide their own API keys for AI providers and Git hosting platforms.
3. User Accounts and API Keys
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You are solely responsible for all activities that occur under your account.
- You must provide accurate, current, and complete information during registration.
- We do not store your API keys in plain text and are not liable for any charges incurred on your third-party API accounts.
4. Intellectual Property and Usage Rights
- When you generate content using gitpage, you own the HTML, CSS, and JavaScript code output.
- You may use the generated code for personal and commercial purposes.
- You do NOT have the right to resell, redistribute, or sublicense gitpage itself or create derivative services based on our platform.
- All gitpage branding, logos, and proprietary technology remain our exclusive property.
5. GitHub Pages / GitLab Pages Hosting Restrictions
By default, websites generated through gitpage are hosted on GitHub Pages or GitLab Pages. Users must comply with the respective platform's Terms of Service. GitHub Pages, for example, prohibits:
- Running online businesses or e-commerce sites
- Facilitating commercial transactions
- Providing commercial Software as a Service (SaaS)
- Handling sensitive transactions like passwords or credit card information
For commercial use, you own your generated code and may deploy it to commercial hosting platforms such as Netlify, Vercel, AWS, or other appropriate services.
6. NO REFUNDS POLICY - PLEASE READ CAREFULLY
ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS, CREDITS, OR EXCHANGES UNDER ANY CIRCUMSTANCES.
By purchasing a subscription or one-time payment to gitpage, you acknowledge and agree that:
a) Digital Nature of Service: Our service provides immediate access to digital tools and AI-generated content. Once access is granted, the service is considered fully delivered.
b) No Cooling-Off Period: You expressly waive any statutory cooling-off or withdrawal period that may otherwise apply. You acknowledge that by accessing our services immediately upon purchase, you forfeit any right to cancel or receive a refund.
c) International Users: gitpage is an Australian company operated under Australian law. Regardless of your location (including but not limited to the European Union, United Kingdom, United States, or any other jurisdiction), you agree that:
- Australian law governs these Terms and any disputes
- No foreign consumer protection laws, including EU Consumer Rights Directive, UK Consumer Contracts Regulations, or similar legislation, shall apply to your purchase
- You have been clearly informed of and consent to this no-refund policy BEFORE making your purchase
d) Chargeback Warning: If you initiate a chargeback or payment dispute after using our services, we reserve the right to:
- Immediately terminate your account and access
- Pursue recovery of the disputed amount plus administrative fees
- Report fraudulent chargebacks to relevant authorities and credit agencies
e) Service Issues: If you experience technical issues with our service, please contact us at support. We will make reasonable efforts to resolve technical problems but this does not entitle you to a refund.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- gitpage is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
- We are not responsible for any issues arising from third-party services (AI providers, GitHub, GitLab, payment processors).
8. Indemnification
You agree to indemnify and hold harmless gitpage, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
9. Termination
We may terminate or suspend your access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Australia, specifically the State of New South Wales.
You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for any disputes arising out of or relating to these Terms or your use of our services.
You waive any objection to venue in these courts and agree not to commence any legal proceedings in any other jurisdiction.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.
